  1. INTRODUCTION

M TO M Mart (“We”, “Us”, “Our”) owns and operates the mobile application namely __MtoM__ (“Application”), a real-estate community management Application that is designed to automate numerous operations within residential and commercial colonies and to improve convenience, safety, and security of its users. 

This Privacy Policy (“Policy”) aims to describe how We process, collect, store and use the personal information/ sensitive personal information (defined below) of its users (“Users”, “You”, “Your”).  The Policy covers the Application's access and usage, as well as the utility services offered through it. Your access to and use of the Policy indicates that You have read, understood and agreed fully to this Policy. You acknowledge and understand that any personal information/ sensitive personal information You part with Us, is only after You have voluntarily consented to this Policy. 

You further agree that the personal information You provide Us is lawful, true, and accurate, and that it does not violate or infringe any laws of India or any contractual arrangement that You may have with any third party. We will not be accountable to You or any third party for any violations, infringements, or the provision of false or unauthorised information or for any legal action or claim arising out of Your sharing of personal information with Us.

This Policy is governed by the provisions of the Information Technology Act of 2000 and the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 made thereunder (the "Applicable Law"). 

For the purposes of this Policy, Personal Information means any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available with a body corporate, is capable of identifying such person. It also includes Sensitive Personal Data or Information. Sensitive Personal Data or Information of a person means such personal information which consists of passwords in encrypted form as well as financial/ payment-related information such as bank account or credit card or debit card or other payment instrument details. 

  1. What Personal Information We Collect 

2.1 On the basis of Your usage of Our Application, We ask for the following Personal Information or Sensitive Personal Information. This information is required for Us to fulfil Our responsibilities and comply with Our legal obligations.

  1. Information relating to Your account- We may ask You to create a user account (the "Account") in order to utilise the service(s) offered on Our Application, which will be subject to verification by the resident welfare association or directly by You. When You create an Account, You must provide Us with certain Personal Information, such as Your first and last name, email address, date of birth, and demographic information such as age or sex. 

  1. In addition to the above (A), We may require You to provide certain additional Personal Information, such as 

  • For Residents - Name, phone number, apartment number, vehicle number (if applicable), and any other information you choose to enter on Our Application; 

  • For Guests - Name and address of the person(s) to be visited. For access at the gate, no extra visitor information is necessary on the Application.

  1. Payment-related information- When You avail of any payment-related service(s) on Our Application either from Us or from any third-party service provider, We and/or the service provider may require certain Sensitive Personal Information such as your credit/debit card details in order to facilitate the specific performance and processing of such payment. 

  1. Communications with affiliates/authorised service providers/agents and support staff - We collect information about Your communication and any other extra information that You choose to supply Us when You communicate with affiliates or authorised service providers/agents associated with Our Application. 

When You contact Us for redressing grievances or queries, Your communications with Our support staff may be collected and stored for Our future reference and training purposes. The communications may be stored and monitored by Us for the sake of resolving disputes.  

  1. Information of visitors (only for residents/commercial unit owners)- Third-party vendor/guest access to the society/apartments is governed by Our Application and is subject to your consent. 

2.2 Information collected from service providers- These are the third-party service provider(s) who use Our Application to list their business and give services. We may collect Personal Information (Aadhaar-PAN card-based details, etc.) from such Users, as well as information about their business, a description of their services, contact information, location, and payment information (bank account details, etc.). As may be agreed basis of Our consent and instructions, the afore-mentioned Users may also submit additional information, such as photos or videos related to their business. 

  1. How We Use Your Personal Information

Personal Information/Sensitive Personal Information shared with Us will solely be used to offer You the service(s) that You avail. You acknowledge and agree that Your Personal Information/ Sensitive Personal Information is being collected with Your informed, voluntary and explicit consent. 

Furthermore, Personal Information is used for the purpose of compliance with the Applicable Law and to detect and prevent any abuse of Personal Information/Sensitive Personal Information. Personal Information may also be used to intimate You about any ongoing or upcoming promotions or offers. 

  1. How long do We retain Your Personal Information

Personal Information/ Sensitive Personal Information is only collected for legitimate reasons. We retain Your Personal Information/Sensitive Personal Information for as long as it is necessary for Us to achieve the purposes for which it was obtained, as well as long as the Applicable Law demands. However, there may be instances when We need to keep such information for a longer period of time e.g., in the event of a dispute. Some of Your Personal Information may be retained if it is necessary for Our legitimate business purposes, such as fraud detection, fulfilling contractual duties and improving the safety or the quality of Our services.

In case You stop accessing or using the Application, We may have to retain the Personal Information provided by You for such a short period of time until the same can be erased from Our servers, and for compliance with its obligations under the Applicable Law.

  1. Disclosure of Personal Information 

We share Your Personal Information with the following categories of recipients; 

  1. Third-party service providers and vendors: We work with a number of third-party service providers and vendors to deliver Our services, as well as utilities and living-related services (water, laundry, mobility, and so on), and payment services. These service providers and vendors have access to Your Personal Information only to the extent necessary to do their duties on Our behalf, and they are contractually obligated to keep it safe and secure. 

  1. Other Users of the Application: For service professionals, most of their details are displayed publicly on the Application. For Consumers, information such as their name, location and service requested will be shared with the service professionals who have been booked and/or other Users of the Application.

  1. On Your Request: We may share Your Personal Information with other Users of the Application if You have explicitly requested the same and the scope of such sharing will be limited to the purposes for which the Application is being used. 

  1. Change of Control or Bankruptcy: If We undergo a change of control via a merger or acquisition of Our assets by/with a successor company/firm, then We may have to hand over all Your Personal Information to such a successor. Furthermore, in the unfortunate event of bankruptcy for any reason whatsoever, We may be obligated to transfer Your Personal Information to a third-party entity.

  1. Compliance with law: We can share Your Personal Information when compelled by a government agency, law, regulation, a court or other legal process. 

Please note that where We share Your Personal Information or Sensitive Personal Information with any of the above recipients, We will put in place suitable security safeguards to protect that information, as required by the Applicable Law. 

  1. Data security 

We protect Your Personal Information/Sensitive Personal Information by implementing security practices and standards that contain technical, managerial, operational and physical security control measures. 

You acknowledge and agree that We cannot possibly guarantee absolute protection against loss of information. As the internet is susceptible to unforeseen security issues, We can only make reasonable efforts to protect Your Personal Information, but cannot give an absolute guarantee regarding the same. We shall not be liable in the event Your Personal Information is unauthorizedly disclosed on account of improper use or disclosure, unauthorized modification and unlawful destruction or accidental loss of information, or any security breach which is beyond Our reasonable control.

  1. Rights of the Users

You shall have the following rights under this Policy:

  1. Right to request access to Your Personal Information: You may seek access to Your Personal Information at any time after You have given Your consent to its collection by writing an email to mtommart2345@gmail.com. We will give You reasonable access to Your information within 7 working days, or within the timeframe required by Applicable Law.

  1. Right to request correction of Your Personal Information: You may request that We amend or update Your Personal Information at any time after You have consented to its collection by writing an email to the above-mentioned email address. You will be solely accountable for any failure to rectify or update Your Personal Information.

  1. You may request Us to delete Your personal data or sensitive personal data by sending us an email to the above-mentioned email address. If the deletion of such data affects the provision of Our services then We retain the right to withdraw the same. 

  1. Third-Party websites 

Links to third-party websites/applications may be found on the Application. You will be redirected to third-party websites/applications if You choose to click on such links. Please be aware that when You are redirected to a third-party website/application, Our Terms of Use and Privacy Policy no longer apply. You should read the privacy policies of such third-party websites/applications before submitting any Personal Information to them. We will not be held liable for any data loss that may occur while using such third-party websites/applications.

  1. Governing Law

This Policy shall be construed and governed by the laws of India and You hereby agree to submit to the exclusive jurisdiction of the courts at Vijayawada, Andhra Pradesh in the event of any dispute arising in connection with this Policy.

  1. Changes to the Policy

This Policy may be changed, modified, revised, edited, or altered at any time in response to changes to the Application or its services. If and when the Policy is altered, We will inform You and instruct You to read the modified Policy again. Even if nothing changes, We shall ask You to review this Policy on a regular basis. If You continue to use the Application, this will be interpreted as Your acceptance of the amended Policy. This Policy's most recent update date will be shown at the top.
